General Terms and Conditions (GTC):
§1. Definitions
1. ajandeklepesek.com – The online portal (webshop) available at ajandeklepesek.com, through which the Customer can purchase goods and digital content offered for sale in the online store, and through which the Seller provides electronic services.
2. Goods – Physical products that can be the subject of sale and can be purchased on the ajandeklepesek.com website.
3. Digital Content – Digital content available for purchase on the ajandeklepesek.com website, which is not delivered on a physical medium and can be the subject of sale.
4. User – Any natural person, legal entity, or organizational unit without legal personality that has its own account on the ajandeklepesek.com website.
5. Customer – Any natural person, legal entity, or organizational unit without legal personality who makes a purchase on the ajandeklepesek.com website.
6. Consumer – A natural person purchaser who concludes a contract with the Seller within the framework of the ajandeklepesek.com webshop that is not directly related to their economic or professional activity.

8. Digital Service – A service that enables Customers to purchase goods and digital content available on the ajandeklepesek.com website.
9. Visitor – Any natural person, legal entity, or organizational unit without legal personality who visits the ajandeklepesek.com website as a non-logged-in User or without their own account on the ajandeklepesek.com website.
10. Graphic Work – A work as defined under Act LXXVI of 1999 on Copyright.
11. Entrepreneur – Any natural person, legal entity, or organizational unit without legal personality, which is granted legal capacity under a separate law, conducts business in its own name, and uses the ajandeklepesek.com webshop in connection with its own business activity.
12. Entrepreneur with Consumer Rights – A natural person who concludes a contract directly related to their business activity, provided that it is clear from the content of the contract that it is not of a professional nature for them.
13. Consumer Rights – Act CLV of 1997 on Consumer Protection.
- General Terms and Conditions (GTC) – These General Terms and Conditions, referred to in relation to Electronic Services under the Act CVIII of 2001 on Electronic Commerce Services and certain issues concerning services related to the Information Society.
§2. Legal Basis
Serbian law shall apply; however, EU consumer protection rules shall always apply to Hungarian customers.
To use the ajandeklepesek.com website, the following are required:
a) A computing device with an installed browser configured to access ajandeklepesek.com at the ajandeklepesek.com web address, to accept and use cookies, and to connect to the Internet network.
b) An active electronic mailbox (email).
§4. Legal Requirements
1. Every User and Customer is obliged to read and unconditionally accept the provisions of the GTC before using ajandeklepesek.com.
2. Every User and Customer declares that they have full legal capacity.
§5. Subject of the GTC
The GTC define the conditions under which the ajandeklepesek.com Company provides digital services through the webshop available on the ajandeklepesek.com website.
§6. Purpose of the Digital Service
The main purpose of the Digital Service is to enable Users and Visitors to purchase Goods and Digital Content.
§7. Due Diligence
1. ajandeklepesek.com is committed to providing the highest level of service.
2. For products requiring custom graphic design, ajandeklepesek.com Company shall prepare the design specifically for the Customer.
§8. Registration Not Required
1. Browsing the product selection on ajandeklepesek.com does not require registration.
2. Purchasing products from the ajandeklepesek.com webshop does not require registration.
§9. Account Registration on ajandeklepesek.com
1. To register on the ajandeklepesek.com website, the registration form must be completed with a name or nickname (alias), email address, and password, and the ajandeklepesek.com GTC must be accepted.
2. Registration on the ajandeklepesek.com website is voluntary and free of charge.
§10. Login
After registering on the ajandeklepesek.com website, each time a User logs in, they must use the data provided on the registration form.
§11. Account Deletion

§12. Offer to Conclude a Contract
Information regarding Goods and Digital Content available on ajandeklepesek.com constitutes an offer to conclude a contract within the meaning of the Civil Code (Act V of 2013).
§13. Prices
The prices of Goods and Digital Content displayed on the ajandeklepesek.com website:
· Include VAT and are given in Hungarian forints, as gross amounts.
· Do not include shipping costs. Shipping costs depend on the method of delivery, the value, and size of the order, and are displayed when the Customer selects the shipping method. The total order cost (i.e., the price of the Goods including shipping) is shown in the cart before the Customer places the order.
§14. Price Modifications
1. The ajandeklepesek.com Company reserves the right to continuously modify the prices of Goods. This right does not affect orders placed before the price change takes effect.
2. In the case of a price reduction, ajandeklepesek.com shall indicate both the reduced price and the lowest price of the Goods in the past 30 days.
3. Digital Content is delivered without a physical medium. After payment, the Digital Downloads service provides the Customer access to the digital product via a download link sent to their email. Any errors will be corrected within 24 hours.
4. Invoices and credit notes are sent exclusively by email.
§15. Payment

§16. Terms and Conditions of Promotions
1. ajandeklepesek.com occasionally announces promotions in the webshop. The duration of each promotion is specified in the offer announcing the promotion.
2. Every participant in a promotion will receive the promotional products, or the appropriate discounts will be applied when purchasing in the webshop.
3. Promotions cannot be combined with other promotions or discounts.
§17. Complaints
1. ajandeklepesek.com is responsible to the Customer if the purchased digital product is defective.
A sold Good does not comply with the sales contract, particularly if:
· It does not have the properties that such a type of Good should have for the purpose specified in the sales contract, based on circumstances or intended use,
· It does not have the properties guaranteed by ajandeklepesek.com to the Customer,
· It is unsuitable for the purpose communicated by the Customer when concluding the Sales Contract, provided no objection was raised against this purpose,
· It was received by the Customer incompletely.
4. In case of a defect, the Customer may submit a warranty claim to ajandeklepesek.com and request one of the following measures:
· Withdrawal from the contract – if the defect is significant (at least provable with images)
· Resending of the download link
The choice of action is up to the Customer.
5. The Customer may use out-of-court methods for reviewing complaints and enforcing claims, including:
· Filing a complaint with the consumer protection authority competent for their residence for out-of-court dispute resolution.
· Initiating proceedings with the competent conciliation body for disputes arising from the concluded sales contract, or contacting a conciliation body operating within the relevant professional chamber.
6. The use of out-of-court complaint and redress procedures is voluntary, and both parties must agree to participate. Detailed information on out-of-court handling and enforcement of complaints and claims, as well as access rules, is available on the websites of county (city) consumer protection authorities, consumer protection organizations, and competent authorities.
7. The Customer may seek assistance in resolving disputes arising from the contract from the county (city) consumer protection authority or from a social organization responsible for consumer protection.
8. Concerning online dispute resolution for consumer disputes, under the EU Regulation 524/2013/EU (May 21, 2013) and the relevant amendments, the European Commission has created an online dispute resolution platform, available from February 15, 2016, for resolving disputes arising from online sales or service contracts: ec.europa.eu/consumers/odr.
9. The European ODR platform is an interactive website through which the Customer, as a Consumer, can submit a complaint.
10. The purpose of the ODR platform is to facilitate the independent, impartial, transparent, effective, quick, and fair out-of-court online resolution of disputes arising from obligations under online sales or service contracts concluded between Consumers residing in the Union and Traders established in the Union.
§18. Right of Withdrawal
Under European Union and Hungarian law, consumers generally have the right to withdraw from an online purchase within 14 days without giving any reason.
However, in the case of digital content (e.g., downloadable files, software, e-books, subscriptions, activation codes), the right of withdrawal is lost if the following conditions are met:
· The customer explicitly agrees that the service performance (access provision, download start) begins immediately.
· The customer clearly acknowledges that by doing so, they lose their 14-day right of withdrawal.
Therefore, before finalizing the purchase, the consumer must declare (e.g., by checking a box) that they understand and accept the above.
§19. Service Availability
1. ajandeklepesek.com shall not be liable, to the fullest extent permitted by law, for any disruptions in the operation of the ajandeklepesek.com webshop, including interruptions caused by force majeure, unauthorized acts by third parties, or incompatibility between the technical infrastructure of ajandeklepesek.com and the Customer.
2. ajandeklepesek.com makes every effort to ensure the highest quality of services; however, temporary unavailability of the webshop may occur due to necessary updates, expansions, maintenance, inspections, or equipment replacements.
§20. Use of the ajandeklepesek.com Webshop
The User may access all available functions of ajandeklepesek.com, including the purchase of Goods offered on ajandeklepesek.com.
§21. Consumer Reviews
ajandeklepesek.com ensures that reviews published on the website come only from consumers who have actually purchased or used the respective product. Verification is carried out as follows: when adding a review, the consumer must provide the order number to which the review relates. If there was no product in the order corresponding to the review, the system automatically rejects it.

§23. Validity of Provisions
If any provision of these Terms of Service (ToS) is declared invalid by a competent court or authority, the remaining provisions shall remain in effect.
§24. Jurisdiction
1. Any disputes between a User or a Customer who is not a Consumer or a Business with Consumer Rights and ajandeklepesek.com shall be resolved by the court competent for the registered office of ajandeklepesek.com.
2. In disputes between a User or Customer considered a Consumer or Business with Consumer Rights and ajandeklepesek.com, the User or Customer may choose the competent court from the authorized courts.
3. For consumer disputes, Hungarian consumers may choose a Hungarian court, in accordance with EU regulations.
§25. Applicable Law
Matters not regulated in these ToS are governed by Serbian law.
For consumers residing in Hungary, Hungarian law and EU consumer protection regulations (especially Directive 2013/524/EU and Act CXII of 2011) always apply.
In consumer disputes, Hungarian customers have the right to choose either a Hungarian court or the Hungarian conciliation body, in accordance with EU regulations.
The remaining provisions of the ToS shall be interpreted in accordance with Serbian law, ensuring full protection of buyers’ rights.
§26. Blocking of Sent Messages
To the fullest extent permitted by law, ajandeklepesek.com shall not be responsible if email server administrators block the delivery of messages to the email address provided by the User or Customer, or if software installed on the User’s or Customer’s computer deletes or blocks emails.
§27. Modification of Terms of Service
1. ajandeklepesek.com may modify the ToS, provided that the updated ToS is made available to Users, Customers, and Visitors at least 14 days before it takes effect, in a way that allows review of the new or amended provisions.
2. If a User does not accept the modification of the ToS, they must contact ajandeklepesek.com by email within 14 days of receiving the notification to inform the company of the rejection of the new or amended provisions.
3. If the User does not accept the modification, ajandeklepesek.com will immediately delete the User’s account on the website upon receiving such information, and the new ToS provisions will not apply to that User.
4. Orders placed by Customers before the new ToS provisions take effect will be fulfilled according to the previous version of the ToS.
§28. Availability of Terms of Service

§29. Annexes
These ToS include two annexes: the first annex is the withdrawal statement, and the second annex is the Privacy Policy, which contains provisions on the protection of personal data.
§30. Entry into Force of Terms of Service
These Terms of Service shall enter into force on September 20, 2025.
